Welcome to Tabital Pay

This Merchant Policy outlines the rules, responsibilities, operational standards, and compliance requirements for merchants using Tabital Pay services.

By registering or using Tabital Pay as a merchant, you agree to comply with this Merchant Policy, applicable laws, and all related Tabital agreements and operational requirements.

  1. About Tabital Pay

Tabital Pay is a Buy Now Pay Later (BNPL) and digital payments platform that enables approved merchants to offer flexible installment payment options to customers.

Tabital Pay provides payment facilitation and financing support but is not the seller, manufacturer, distributor, or owner of merchant products or services unless expressly stated.

Merchants remain fully responsible for:

  • Product quality
  • Product availability
  • Delivery obligations
  • Returns and exchanges
  • Customer support
  • Warranty obligations
  • Compliance with applicable laws
  1. Merchant Eligibility

To use Tabital Pay, merchants may be required to provide:

  • Business registration documents
  • Ghana Card or valid identification
  • Tax identification information
  • Bank or mobile money settlement details
  • Business address and contact information
  • Product or service information
  • Additional compliance documents where required

Tabital Pay reserves the right to approve, reject, suspend, or terminate merchant accounts at its discretion based on risk, compliance, fraud, operational, or regulatory considerations.

  1. Merchant Responsibilities

Merchants agree to:

  • Provide accurate business information
  • Deliver products and services as advertised
  • Honor return and refund obligations
  • Maintain fair pricing practices
  • Avoid deceptive or misleading conduct
  • Comply with Ghanaian consumer protection laws
  • Protect customer information
  • Cooperate with fraud investigations and disputes
  • Maintain operational and customer service standards

Merchants must not:

  • Process fake transactions
  • Inflate pricing for Tabital customers
  • Split transactions to bypass limits
  • Use Tabital for prohibited or illegal activities
  • Submit fraudulent refund requests
  • Manipulate installment transactions
  • Misrepresent product availability
  1. Restricted Businesses and Activities

Tabital Pay may prohibit or restrict merchants involved in:

  • Illegal products or services
  • Gambling or betting
  • Adult content
  • Weapons or firearms
  • Counterfeit goods
  • Fraudulent schemes
  • Unlicensed financial services
  • Cryptocurrency scams or high-risk schemes
  • Any activity prohibited under Ghanaian law

Tabital Pay may update restricted categories at any time.

  1. Payments and Settlements

Approved transactions will be processed according to Tabital Pay settlement schedules.

Settlement timelines may vary depending on:

  • Merchant risk level
  • Transaction verification
  • Fraud reviews
  • Banking or mobile money processing timelines

Tabital Pay may:

  • Delay settlements for investigations
  • Hold reserves for high-risk merchants
  • Offset refunds, chargebacks, penalties, or disputes against future settlements
  • Reverse transactions where fraud or errors are identified
  1. Merchant Fees

Merchants agree to applicable:

  • Transaction fees
  • Processing fees
  • Service fees
  • Settlement deductions
  • Chargeback costs where applicable

All fees will be disclosed in the merchant onboarding or commercial agreement.

Tabital Pay reserves the right to update pricing with prior notice where required.

  1. Refunds and Returns

Merchants are responsible for managing:

  • Returns
  • Exchanges
  • Product disputes
  • Customer complaints

Refund requests must be submitted accurately and promptly through approved Tabital channels.

Where refunds are approved:

  • Installment schedules may be adjusted
  • Future payments may be canceled
  • Previously collected funds may be reversed where applicable

Merchants must not approve fraudulent or duplicate refunds.

  1. Fraud Prevention and Risk Monitoring

Tabital Pay may monitor merchant activity for:

  • Fraud
  • Suspicious transaction patterns
  • Excessive refund rates
  • Chargeback abuse
  • Collusion schemes
  • Identity verification concerns

Tabital Pay may:

  • Request additional documents
  • Suspend transactions
  • Restrict settlements
  • Terminate merchant access
  • Report unlawful activity to authorities
  1. Data Protection and Confidentiality

Merchants must:

  • Protect customer information
  • Use customer data only for authorized business purposes
  • Maintain reasonable security safeguards
  • Comply with Ghana Data Protection Act, 2012 (Act 843)

Merchants may not:

  • Sell customer data
  • Share customer information unlawfully
  • Use customer contacts for harassment or unauthorized marketing
  1. Branding and Marketing

Approved merchants may use Tabital Pay branding only in accordance with official brand guidelines.

Merchants may not:

  • Misrepresent partnership status
  • Modify Tabital branding without approval
  • Make misleading financing claims
  • Advertise false installment offers

Tabital Pay reserves the right to request removal of unauthorized branding usage.

  1. Suspension and Termination

Tabital Pay may suspend or terminate merchant access where:

  • Fraud is suspected
  • Regulatory violations occur
  • Excessive disputes or complaints arise
  • Operational risks increase
  • Merchant information is inaccurate
  • This policy is violated

Termination does not remove outstanding financial obligations owed to Tabital Pay.

  1. Limitation of Liability

Tabital Pay is not responsible for:

  • Product defects
  • Merchant delivery failures
  • Customer misuse of products
  • Indirect or consequential damages arising from merchant transactions

Merchants remain responsible for their own products, operations, and legal compliance.

  1. Regulatory Compliance

Merchants must comply with:

  • Ghana consumer protection requirements
  • Tax obligations
  • Anti-money laundering regulations
  • Data protection laws
  • E-commerce regulations
  • Applicable licensing requirements

Tabital Pay may cooperate with regulators, law enforcement, and financial institutions where legally required.

  1. Policy Updates

Tabital Pay may update this Merchant Policy periodically.

Continued use of Tabital services after updates constitutes acceptance of the revised policy.
