Tabital Pay – Customer Terms & Conditions
These Terms and Conditions govern your use of Tabital Pay services, website, mobile application, and all related products and services provided by Tabital Pay (“Tabital”, “we”, “our”, or “us”).
By creating an account, accessing, or using Tabital Pay, you agree to be legally bound by these Terms and Conditions.
1. About Tabital Pay
Tabital Pay is a Buy Now, Pay Later (“BNPL”) platform that allows eligible customers to purchase goods and services from approved merchants and pay in installments over time.
Tabital is not the seller, manufacturer, distributor, or delivery provider of products purchased through merchants using Tabital Pay.
2. Eligibility
To use Tabital Pay, you must:
- Be at least 18 years old
- Be legally capable of entering into binding agreements
- Be resident in Ghana or another approved country
- Provide accurate and complete information
- Use payment methods registered in your own name
- Pass Tabital’s verification and risk assessment checks
Tabital reserves the right to approve, reject, suspend, or terminate any account at its sole discretion.
3. Account Registration
You agree to provide truthful and up-to-date information including:
- Full legal name
- Mobile number
- Ghana Card or valid identification
- Date of birth
- Email address
- Residential address
- Payment details
You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
You must notify Tabital immediately if you suspect unauthorized access or fraudulent activity.
4. Credit & Approval
Tabital may assess your eligibility using:
- Internal risk models
- Payment history
- Credit bureau checks
- Fraud prevention systems
- Transaction behavior
- Mobile money and banking verification
Approval is not guaranteed and may vary per transaction.
Tabital reserves the right to:
- decline transactions,
- reduce spending limits,
- suspend installment access,
- request additional documentation,
- or demand upfront payment.
5. Payment Terms
When you use Tabital Pay, you authorize us to charge your selected payment method for all due installments and fees.
Payments may be made through:
- Mobile Money
- Debit cards
- Bank transfers
- Other approved payment methods
You agree to maintain sufficient funds for scheduled repayments.
Failure to make payments may result in:
- Late payment fees
- Account suspension
- Reduced spending limits
- Debt recovery actions
- Reporting to credit bureaus
- Legal proceedings
6. Late Payments & Default
If you fail to pay on time:
- Tabital may charge late payment fees where permitted by Ghanaian law.
- Automated retries may be made on your saved payment methods.
- Your account may be restricted or permanently blocked.
- Outstanding balances may be referred to collections or legal recovery agents.
Tabital reserves the right to demand immediate repayment of all outstanding balances in the event of fraud, abuse, or default.
7. Merchant Transactions
Merchants are solely responsible for:
- product quality,
- delivery,
- warranties,
- returns,
- pricing,
- and customer service.
Tabital only provides financing and payment facilitation services.
Any disputes regarding goods or services must first be addressed directly with the merchant.
8. Refunds & Cancellations
Where a merchant approves a refund:
- the refund will first be applied to outstanding Tabital balances;
- excess amounts may be returned to your original payment method.
Refund processing times may vary.
Late fees already charged may remain payable unless otherwise determined by Tabital.
9. Buyer Protection
Eligible purchases may qualify for Tabital Buyer Protection where:
- items are not delivered,
- items significantly differ from description,
- or fraud is confirmed.
Tabital reserves the right to investigate claims and request evidence before approving any reimbursement.
Fraudulent claims may result in permanent account termination and legal action.
10. Prohibited Activities
You agree not to:
- use Tabital for unlawful activities;
- provide false or misleading information;
- abuse promotions or referral programs;
- attempt fraud or chargeback abuse;
- share accounts with third parties;
- interfere with the platform or systems;
- use Tabital for money laundering or prohibited transactions.
Violation may result in immediate suspension, legal action, or reporting to authorities.
11. Communications
You consent to receive:
- SMS notifications,
- emails,
- calls,
- WhatsApp messages,
- push notifications,
- and other electronic communications from Tabital.
These communications may include:
- payment reminders,
- account alerts,
- marketing messages,
- security notifications,
- and legal notices.
12. Data Protection & Privacy
Tabital may collect, process, store, and share your personal data for:
- identity verification,
- fraud prevention,
- credit assessment,
- collections,
- customer support,
- regulatory compliance,
- and service improvement.
Your information may be shared with:
- credit bureaus,
- payment providers,
- regulators,
- fraud prevention agencies,
- collection agencies,
- and business partners where legally permitted.
By using Tabital, you consent to such processing.
13. Intellectual Property
All Tabital branding, logos, technology, software, content, trademarks, and materials remain the exclusive property of Tabital.
You may not reproduce, copy, modify, distribute, or exploit any Tabital intellectual property without written permission.
14. Limitation of Liability
To the maximum extent permitted by law, Tabital shall not be liable for:
- merchant disputes,
- delivery failures,
- product defects,
- indirect losses,
- loss of profits,
- data loss,
- or business interruption.
Tabital services are provided “as is” and “as available.”
15. Suspension & Termination
Tabital may suspend or terminate your account at any time where:
- you breach these Terms;
- suspicious activity is detected;
- required verification is not completed;
- payments remain overdue;
- or regulatory concerns arise.
Termination does not remove your obligation to repay outstanding balances.
16. Collections & Credit Reporting
You authorize Tabital to:
- contact you regarding outstanding payments;
- engage third-party collection agencies;
- report repayment history to credit bureaus;
- and recover debts through lawful means.
Failure to repay may negatively affect your credit profile.
17. Changes to Terms
Tabital may update these Terms at any time.
Updated Terms become effective once published on our website or app.
Continued use of Tabital after updates constitutes acceptance of the revised Terms.
18. Governing Law
These Terms shall be governed by the laws of the Republic of Ghana.
Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Ghana.
19. Force Majeure
Tabital shall not be liable for delays or failures caused by events beyond reasonable control including:
- internet outages,
- cyber attacks,
- power failures,
- strikes,
- pandemics,
- regulatory actions,
- or natural disasters.

21. Definitions
